Did you know that TAR helps save you from frivolous lawsuits? That’s right. In 2011, thanks to efforts by the Texas Association of REALTORS®, the state legislature amended the Deceptive Trade Practices Act to protect you. The Deceptive Trade Practices Act, also known as DTPA, was sometimes getting abused, leading to meritless lawsuits against real estate professionals. Now, unless you commit an unconscionable act, misrepresent a material fact, or fail to disclose something with the intention of inducing a consumer into a transaction, you should not be held liable under the DTPA. That’s not to say you can’t be sued, so TAR created a letter that you can use to respond to frivolous Deceptive Trade Practices Act lawsuits. Find it at texasrealestate.com.
